Vivergo Fuels v Redhall Engineering - Dispute goes on
FOLLOWING ANNOUNCEMENTS made on Monday 1st Aug 2011 that Redhall Engineering was claiming a victory in the ongoing contractual dispute at the Saltend bio-ethanol construction site, Vivergo has now hit back with a counter claim that the same adjudicator had found that Redhall was in "material breach" of its contract.
Vivergo Fuels has said it stands by the decision to terminate its contract with Redhall Engineering and disputes any claim for damages for up to £16.7m but accepts that it failed to give Redhall adequate notice of its termination of contract.
In a statement yesterday published on TheBusinessDesk.Com, Vivergo said "We welcome the finding of the adjudicator that confirms that Redhall was in material breach of the contract, and are disappointed that, in the adjudicator’s opinion, we failed to give the correct notice."
